A Montrealer who claims to have been sexually assaulted by her own brother from the age of 7 and for about fifteen years has just brought back a civil prosecution and claims no less than $ 5M for the “nightmare” that she says she has suffered.
“Its quality of life has been undeniably altered, it is permanently affected by physical and mental pain, sufferings and disadvantages,” read the Court document filed by lawyer John T. Pepper and recently made public at the Montreal Palace of Justice.
The prosecution aims at Yvon Jeghers, an Ottawa resident who lives in a large villa on a land of four acres whose land value is established at $ 1.8 million. The alleged gestures would have occurred between 1969 and 1984.
At the time, there was a three -year prescription to bring a civil prosecution. However, this period was abolished in 2020, so that the woman, now elderly in the sixties, was able to start procedures before the courts.
A “nightmare”
According to court documents, the abuses started when the woman was just a child. In addition to “touching up all of his body”, there would also have been complete sexual acts as well as psychological violence and “severe grip”.
The whole would have lasted 15 years, until the woman was aged twenty.
-“Following sexual assault, she was forced throughout her life to use medical and psychological care in an attempt to overcome the nightmare in which he had plunged it,” said the court document.
However, if Yvon Jeghers has never been accused of the criminal, his sister decided to prosecute him in civilian. Since the end of the prescription, we also see this kind of procedure more and more regularly, sometimes leading to civil convictions and forcing attackers to untie the cords of their purse.
He denies everything
In this case, the woman claims $ 5 million. But obviously, she will have to go to the end to gain their case, since her brother denies the reproaches.
“He never abused or attacked [la femme] as the latter claims. In addition, he is in no way responsible for the damage she claims to have suffered since her youth, “he said in the response of a lawyer annexed to the file.
Mr. Jeghers said that he could start a prosecution against his sister for defamation, while indicating that he could ask that his lawyers, at the end of the procedures, be paid by the woman.
The prosecution will soon be presented at the Superior Court of Quebec.
