The ex-employee of the CHUV disputes sexual acts committed twice. He concedes that he had only kissed the complainant, crying in court.

In this trial fogged with tears, two versions oppose the Lausanne court. During two passages at Chuna patient would have undergone the impulses of a technician in radiology. Benefiting from the presumption of innocence, he is accused of sexual constraints and sexual acts with hospitalized people. The public prosecutor requires 180 days for 70 francs, suspended for two years, and a fine of 2,500 francs. The man should still pay 4000 francs for moral wrong.
At the CHUV, disturbing reunion
He had met the young woman for the first time in 2004 in the corridors of Chunwhile accompanying her father in treatment. “I immediately had an attraction for her, a love at first sight.” She had then agreed to have a drink with him, but the matter had stopped there. Then, this forties saw her, fifteen years later, in this same hospital in 2019, where she was hospitalized for four days at the center of the hand for surgery.
“I immediately recognized it,” he explains. “Me too,” said the complainant. He called me by phone shortly after our first meeting. And I asked him to stop. ” During this hospital stay, the victim had to undergo an MRI, a task of which the defendant was in charge, alongside two other employees. At the end of this imaging session, he brought it to a room and closed the door.
She was in a rolling chair following a problem with the spine, dressed in a hospital shirt and panties. The technician looked at her and took her in his arms. According to the indictment, he had passed his hand under his shirt, touched her breasts, trying to kiss her on his mouth, while holding her firmly in his arms. She would have been afraid and would have turned her head. But he would have kissed her on the face and neck, before taking his hand and putting it on her sex.
The man, who no longer works at the CHUV, disputes everything except kissing him. “She was a little embarrassed, but she didn’t reject me.” The woman told her that she did not want to, that she was married and that she had children. “I was stressed and shouted,” said the complainant. The defendant finally stopped his actions. He was not at his first time: The CHUV had already given him a warning For similar facts on another patient.
Three years later, in October 2022, the victim had several consultations in the center of the hand. At the end of the exam, she took the elevator to head towards the exit, by the wrong floor and finding herself near a closed door. When she turned around, she found herself against the defendant, who was still a technician in radiology at the CHUV.
The defendant would have spoken to him, would have hugged him and tried to kiss him on his mouth, saying that he wanted to “cuddle”, retains the indictment. Thereafter, he would have taken it firmly by the hand to bring it to a room. The complainant would have tried several times to press the elevator button, but he would have prevented it. The fortuitous passage of a person would have encouraged man to let go. She would have taken the elevator, then would have left the building, not without it following it, to the outside of the building where it smoked a cigarette. She finally left the scene, placing complaints at the end of November 2022.
“He took advantage of his status”
“Are you aware that your function could involve domination over your patient?” requests the president of the court to the defendant. “I understood it afterwards,” he apologizes. Lawyer Zakia Arnouni also raises the state of vulnerability of her patient: “In the silence of the hospital, the technician took advantage of the situation and his status. The facts are serious. They were repeated three years later with a fairly similar operating mode. What would have happened if a person had not been there? ”
For Emmeline Filliez-Bonnard, lawyer for the accused, “this is a case of speech against speech”: “The version of my client is no more contradictory than that of the complainant, who denounced the facts only three years later. We must respect the presumption of innocence. ” Judgment at the Lausanne court next week.
